1. Acceptance of Terms
By accessing or using the Booked Out application ("Service"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Service.
2. Description of Service
Booked Out is a booking platform that connects consumers with wellness, beauty, and lifestyle service providers including massage therapists, hair stylists, personal trainers, restaurants, and other professionals. We facilitate scheduling, payments, communication, and appointment management.
3. User Accounts
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- You must be at least 18 years old to use the Service
- You are responsible for all activity that occurs under your account
4. Bookings and Appointments
- Bookings are subject to provider availability and confirmation
- Cancellation policies are set by individual providers
- No-show fees may apply as determined by the provider
- Booked Out is not responsible for the quality of services rendered by providers
5. Payments
Payments are processed securely through Stripe. By making a payment, you agree to Stripe's terms of service. Refund policies are determined by individual service providers. Booked Out facilitates payment processing but is not a party to the transaction between you and the provider.
6. SMS Communications
Program description. Booked Out sends booking-related text messages, including inquiries, pricing, appointment confirmations, reminders, cancellations, and modifications. You opt in by checking the unchecked-by-default SMS consent box at sign-up, provider onboarding, or checkout, or by texting the keyword START to a Booked Out number. Consent is not a condition of purchase.
Message frequency. Message frequency varies based on your booking activity. You will typically receive between 2 and 10 messages per booking.

Opt out. You can withdraw consent at any time by replying STOP to any Booked Out SMS. We will send a single confirmation message and stop further marketing and notification messages to that number.

Carriers. Supported carriers include AT&T, Verizon, T-Mobile, Sprint, Boost, MetroPCS, U.S. Cellular, Cricket, and most regional carriers. Carriers are not liable for delayed or undelivered messages.
Privacy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. See our Privacy Policy for full details.
7. Provider Responsibilities
Service providers on Booked Out are independent professionals. Booked Out does not employ, endorse, or guarantee any provider. Providers are solely responsible for the services they offer, their licensing, insurance, and compliance with applicable laws.
8. Limitation of Liability
Booked Out provides the platform "as is" and is not liable for any damages arising from your use of the Service, including but not limited to the quality of services provided by third-party providers, payment disputes, or scheduling errors.
9. Modifications
We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify users of material changes via the app or email.
